The chapter examines the legal recognition of de facto partner’s inheritance rights in Fiji. Fiji took a positive step towards, in 2012, in implementing reforms to provide the same legal standing to de facto couples as those of married couples. The Fiji Government introduced recognition of de facto partners’ rights to property and spousal maintenance when relationships ceased. It acknowledged that the Family Law Act 2003 did not afford spouses living in de facto relationships in Fiji the same rights to property and spousal maintenance as those couples married under the civil law. When announcing the amendment, the Attorney-General stated that all Fijians living in a genuine de facto relationship must be afforded the same rights as legally married couples.
