The article discussed that in the modern era of the booming financial system has placed much significance on the coordination of trademark laws. The paper analyses tricky issues around unregistered trademarks outsourcing and protection in India. It scrutinizes some major questions concerning elite rights attached to an unregistered trademark under commercial laws and the remedies available in suits for passing off. The paper also critically analyses the advantages plus development in the protection of unregistered trademark in expanding the market through case study and various legislative propositions.
