Abstract

In this chapter, we explore the relationship between human rights and inclusive education. We argue that the importance of human rights to conceptualisations of inclusive education lies in an emphasis upon the socio-political contexts that create and reinforce disadvantage and exclusion. Examples of these processes are discussed, by looking at areas where the relationship between human rights and inclusive education are particularly pertinent: the marginalisation of Aboriginal peoples and culture within mainstream Australian society and, the exclusion of refugee children. A human rights approach respects and values diverse communities by transcending differences between them. The concept of “cultural competence” can be employed to address issues of social inclusion from a human rights perspective. Cultural competence requires exploration and understanding of the barriers to an inclusive community, including the role of dominant socio-cultural hegemonic forms. We consider how a cultural competence perspective can be used to deconstruct the structures and practices by which certain experiences and identities are marginalised in education settings.
